For Agency

We are retail specialists with an expert knowledge of Shopping Centre, High Streets and Retail Parks throughout the country.  We use our established relationships with owners, retailers and developers to give considered and personally tailored agency advice.

Each instruction is resourced from a Partner level, giving our clients access to an unparalleled agency service. Since 1992 we have worked with Institutional funds, Property Companies, Private Landlords and Retailers resolving issues on both single assets and portfolios.

For Lease Advisory

The lease advisory team enjoys many years experience of both the in and out of town markets which few other firms can match.  We advise a wide range of landlords and retail clients nationwide in connection with rent reviews, lease renewals, dispute resolution and lease restructuring.

Areas of expertise range from High Streets, Shopping Centre, Supermarkets/Food Stores, Department/Variety Stores, Retail Warehousing and Leisure Properties.

Dispute Resolution

There has been a significant increase in the number of lease renewals in recent years. Resolving such disputes through Court is generally an expensive and drawn out exercise. The parties risk the uncertainty of a determination by a judge whose core expertise may not be property.

Our reputation is built on an ability to adapt to changes in the market, whilst still achieving the best outcome for our clients.  This reputation has established us as a first choice retail expert for a number of high profile and individual clients.

As a practice we are well versed in third party techniques, drawing from prior experiences and the benefit of having three members of our team sitting on the President of the Royal Institution of Chartered Surveyors list of approved Arbitrators and Independent Experts for both rent review and PACT disputes.

Green & Partners have a team of experienced dispute resolvers, all of whom are accredited as Arbitrators and Independent Experts by the RICS Dispute Resolution Service (DRS) in respect of rent reviews and lease renewals. Skills cover the full range of the retail sector.

Rent review disputes have been common place for many years, and more recently there has been a significant increase in the number of disputes involving lease renewals. Resolving such disputes through Court is generally an expensive, uncertain and lengthy exercise.

PACT (Professional Arbitration on Court Terms) is promoted by the DRS as a form of Alternative Dispute Resolution to provide a cost effective and speedy alternative to Court, which utilises the experience of sector specialist practitioners.

PACT permits the resolution of lease renewal disputes by an appointed Arbitrator or Independent Expert, drawing where necessary on the expertise of independent legal advisors. The process enables the efficient resolution of what can be quite complicated lease renewal disputes, involving not just rent but also other lease terms.

The process can be limited to written representations to reduce costs or alternatively can be by way of a hearing or a combination of the two.

An offer of the use of PACT by one party in a lease renewal negotiation may be taken into account when the Court assesses liability for costs in any subsequent Court action, if the offer is turned down by the other party without good reason.
